"The Anti-Phishing Consumer Protection Act, 2008" bill contains proposals for hefty civil and criminal penalties, not only for owners of domains used in ‘phishing’, which are a menace, but any domain name using a brand name, trademark name, or names of a government entity, agency, non-profit agency or any business or other entity. If anyone disputes your domain name they can apply for an instant injunction to stop you trading, if they show good cause. This latter proposal, with its huge financial cost implications, is very sweeping and worrying for thousands of legitimate US website owners.

That is to say, if your website is illegal, unethical or immoral and you would like protection from us in this way, we won’t police that as there may be too many who take up the offer for us to check, but we revoke any claim to a domain that has sought protection in this way that falls foul of any law in any American state, beyond the proposed ‘phishing’ law itself; but we also revoke any claim to any domain name seeking protection in this way that operates in any sphere of gambling or pornography, operating legally or otherwise. In addition, should any law arise or be cited that could hold us liable in any way, either under the proposed new ‘phishing’ law cited here, or any derivative of it, and it results in any form of legal action against us in connection with any domain name transferred to us in this way, we hereby revoke any legal claim to that domain name which automatically reverts to the previous owner/s.

Senator Olympia J. Snowe (R-Maine), with the support of Senator Bill Nelson (D-Florida) and Senator Ted Stevens (R-Alaska) recently introduced a bill entitled “The Anti-Phishing Consumer Protection Act of 2008?

The legitimate aim of the bill is to stop ‘phishing’ in e-mails and on websites. Phishing is a scam in which people receive emails or instant messages sending them to a website that looks identical to the site the user expects to see, such as an online bank account. If the user enters personal details on the website, bank accounts and the like can be raided.

In addition, if anyone disputes your domain name they can apply for an instant injunction to stop you trading, if they show good cause.

We do not want any control over your domain name. Consider us guardians of your domain name only. We offer this service for no other reason than to help you protect yourselves.
